If you are an average person, you won’t confuse 50 Cent’s “In Da Club” and Live Crew frontman Luther Campbell’s “It’s Your Birthday.” which shared the disputed phrase, which was a “common, unoriginal, and noncopyrightable element of the song” and was not entitled to copyright protection.

After jury concluded that the compositions have no substantial similarities 50 cents is no longer the song stealer. Moreover, outside of the opening phrase, there are almost no similarities between the works, and the phrase in question represents only eleven seconds of a more than three-minute song.

50 cents will keep singing “In Da Club” while Luther Campbell can think of suing some one else for stealing his unembellished lyrics.
